Claim for Damages

 

If you believe the City of Manhattan is at fault for an incident or accident resulting in loss, damage or injury to you or your property, then you may file a Claim for Damages on the City’s form. 

The Kansas Tort Claims Act, K.S.A. 12-105b, requires specific information to be included in the claim. Please submit the completed City form and all supporting documentation, such as invoices, paid receipts, bills, estimates, and photos. Failure to submit all required information may result in denial of your claim.

The City will investigate the claim to determine whether the City was negligent and liable for the damages based upon the facts and applicable law. State law allows 120 days to respond to the claim, although most claims are processed within 30 to 60 days. You will receive a response from the City Attorney’s Office or the City’s insurer, depending on the nature of the claim.

Where do I get a claim form?

A City of Manhattan Claim Form may be requested of the City Clerk’s Office by telephone or in person.
